Since 25 May 2018, the provisions of the EU General Data Protection Regulation (hereinafter: GDPR) have applied throughout Europe. In the following, we would like to inform you about the processing of personal data carried out by Tradegate AG in accordance with this new regulation (see Article 13 GDPR). Please read our data protection information carefully. The following data protection information informs you about the type and scope of the processing of so-called personal data by Tradegate AG. Personal data is information that is or can be directly or indirectly assigned to your person.


Data processing by Tradegate AG can essentially be divided into two categories:


  • When you access the Tradegate AG website under the domain https://www.tradegate.ag, various information is exchanged between your end device and our server. This may also involve personal data. The information collected in this way is used, among other things, to optimise our website.
  • For the purpose of initiating a contract, all data required for the conclusion and execution of a contract with Tradegate AG will be processed if you contact us with a contract-related request via the contact options on the website for this purpose.

In accordance with the provisions of the GDPR, you have various rights that you can assert against us. These include the right to object to selected data processing. The option to object is highlighted in print.

2.    Name and contact details of the controller and the company data protection officer

This data protection information applies to data processing by Tradegate AG, Kurfürstendamm 119, 10711 Berlin (‘controller’), and to the following website: https://www.tradegate.ag. 3.    Purposes of data processing, legal bases and legitimate interests pursued by Tradegate AG or a third party and categories of recipients

3.1    Accessing our website under the domain https://www.tradegate.ag

When you visit our website under the domain https://www.tradegate.ag, the browser used on your device automatically sends information to the server of our website and temporarily stores it in a so-called log file. We have no influence on this. The following information is also collected without any action on your part and stored until it is automatically deleted

  • The IP address of the requesting internet-enabled device,
  • the date and time of access
  • the name and URL of the retrieved file
  • the website from which the access was made (referrer URL)
  • the browser you are using and, if applicable, the operating system of your internet-enabled computer and the name of your access provider.

The legal basis for processing the IP address is Article 6 (1) lit. f) GDPR. Our legitimate interest follows from the purposes of data collection listed below. At this point, please note that we are not able to draw any direct conclusions about your identity from the data collected, nor do we do so.

The IP address of your end device and the other data listed above are used by us for the following purposes:


  • ensuring a smooth connection setup,
  • ensuring a comfortable use of our website,
  • analysing system security and stability.

The data is stored for a period of two weeks and then automatically deleted. We also use so-called cookies for our website. The exact procedures involved and how your data is used for this purpose are explained in more detail below in section 3.3.


3.2    Conclusion, performance or termination of a contract

3.2.1    Data processing upon conclusion of a contract

The use of our website is generally possible without providing personal data. Insofar as personal data (e.g. name, address or e-mail addresses) is collected on our website, this is always done on a voluntary basis as far as possible.


If, in exceptional cases, you contact us with a specific contract-related request, we will process the data required for the conclusion, execution or termination of a contract with you. This may include:


  • first name, surname,
  • your address,
  • e-mail address,
  • account details,
  • date of birth,
  • telephone number.

The legal basis for this is Article 6 (1) lit. b) GDPR, i.e. you provide us with the data on the basis of the contractual relationship between you and us. We store the data collected for contract processing until the expiry of the statutory or possible contractual warranty rights. After expiry of this period, we retain the information required under commercial and tax law relating to the contractual relationship for the periods specified by law. For this period (regularly ten years from the conclusion of the contract), the data is processed again solely in the event of a review by the tax authorities.


3.2.2    Your identity

Where necessary, we verify your identity using information from service providers. The legal basis for this is Article 6(1) lit. b) and lit. f) GDPR. The authorisation for this arises from the protection of your identity and the avoidance of fraud attempts to our detriment. The fact and the result of our enquiry will be stored in your customer account or guest account for the duration of the contractual relationship.


3.2.3 Contact option via the website

Due to legal regulations, the Tradegate AG website contains information that enables rapid electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (e-mail address). If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties.


3.3 Online presence and website optimisation

3.3.1 Cookies - General information

We use cookies on our website. If these cookies are personal data, they are used on the basis of Article 6(1) lit. f) GDPR. Our interest in optimising our website is to be regarded as legitimate within the meaning of the aforementioned provision. Cookies are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your end device and do not contain any viruses, trojans or other malware. Information is stored in the cookie that results in each case in connection with the specific end device used. However, this does not mean that we obtain direct knowledge of your identity. On the one hand, the use of cookies serves to make the use of our website more convenient for you. For example, we use session cookies to recognise that you have already visited individual pages of our website or that you have already logged into your customer account. These are automatically deleted after you leave our site. In addition, we also use temporary cookies for the purpose of user-friendliness, which are stored on your end device for a specified period of time. If you visit our site again to use our services, it is automatically recognised that you have already visited us and which entries and settings you have made so that you do not have to enter them again.


On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you and to display information tailored specifically to you. These cookies enable us to automatically recognise that you have already visited our website when you return. These cookies are automatically deleted after a defined period of time. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you cannot use all the functions of our website. The storage duration of cookies depends on their purpose and is not the same for everyone.


3.3.2    Objection/opt-out option

In addition to the deactivation methods described, you can also generally prevent the technologies explained by making the appropriate cookie settings in your browser.


3.4    Other processing activities

3.4.1    Applicants/employees

When you apply to us by e-mail, we ask applicants for personal data such as names, addresses, qualifications and professional experience. As soon as a contractual relationship is established between you and us in the context of temporary employment, we require further confidential information, including the tax identification number and tax class. We only collect the absolutely necessary personal data that we require for our services.


As soon as you have provided us with personal information, you can also view or revoke it at any time on request or ask us to correct and, if necessary, delete the data.


We only use your address, telephone number and e-mail address to contact you regarding our services. Tradegate AG may use the personal data collected for statistical surveys. It will only be passed on to third parties if all confidential and personal data (name, address, etc.) has been removed. We do not sell or rent personal data to third parties. Your personal data is stored on specially protected computers and servers. The reading and further processing of your data is subject to strict internal regulations and is carried out exclusively for the purpose for which you have provided us with this data.


Under no circumstances is the information on the Tradegate AG website under the domain https://www.tradegate.ag to be understood as a concrete offer for an employment contract or a recommendation for a specific position.


4.    Recipients outside the EU

We do not pass on your data to recipients based outside the European Union or the European Economic Area.


5.    Your rights

5.1    Overview

In addition to the right to withdraw the consent you have given us, you have the following additional rights if the relevant legal requirements are met:


  • Right to information about your personal data stored by us in accordance with Article 15 GDPR; in particular, you can obtain information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the origin of your data if it has not been collected directly from you,
  • Right to rectification of inaccurate data or completion of correct data in accordance with Article 16 GDPR,
  • Right to erasure of your data stored by us in accordance with Article 17 GDPR, insofar as no statutory or contractual retention periods or other statutory obligations or rights to further storage are to be complied with,
  • Right to restrict the processing of your data in accordance with Article 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it; the controller no longer needs the data, but you need it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing in accordance with Article 21 GDPR,
  • Right to data portability pursuant to Article 20 GDPR, i.e. the right to receive selected data stored by us about you in a commonly used, machine-readable format or to request transmission to another controller,
  • Right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters - in this case, the Berlin Commissioner for Data Protection and Freedom of Information.

5.2    Right to object

Under the conditions of Article 21 (1) GDPR, data processing may be objected to for reasons arising from the particular situation of the data subject.


The above general right to object applies to all processing purposes described in this data protection information that are processed on the basis of Article 6(1)(f) GDPR. In contrast to a specific right to object to data processing for advertising purposes, we are only obliged under the GDPR to implement such a general objection if you give us reasons of overriding importance (e.g. a possible danger to life or health). In addition, you have the option of contacting the supervisory authority responsible for Tradegate AG, the Berlin Commissioner for Data Protection and Freedom of Information.


6.    Duration of the storage of personal data

The duration of the storage of personal data is determined by the respective statutory retention period (e.g. retention periods under commercial and tax law). As a rule, this period is 3 years (e.g. in the case of the regular limitation period for contractual claims) or 10 years (e.g. in the case of retention periods under tax law). After this period has expired, the corresponding data is routinely deleted, provided that it is no longer required for the fulfilment or initiation of the contract and/or we have no legitimate interest in its continued storage.


7.    Data security

All data transmitted by you personally, including your payment data, is transmitted using the generally used and secure SSL (Secure Socket Layer) standard. SSL is a secure and proven standard that is also used, for example, in online banking. You can recognise a secure SSL connection by the s appended to the http (i.e. https://...) in the address bar of your browser or by the lock symbol at the bottom of your browser.
